Acceptance of these terms
These Terms of Service (the “Terms”) govern your access to and use of Telimatic’s websites, the Telimatic console, the Telzino platform, and related services (the “Services”). By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you agree to these Terms for that organization.
The Services and your account
You are responsible for the information you provide, for maintaining the security of your account and credentials, and for all activity that occurs under your account. You agree to provide accurate information and to keep it current. We may update, add, or remove features of the Services over time.
Acceptable use
You agree not to misuse the Services: no unlawful, infringing, or fraudulent activity; no sending of unsolicited or unlawful messages; no attempts to disrupt, reverse engineer, or gain unauthorized access to the Services or other accounts; and no use that violates the rights of others or applicable telecommunications and messaging regulations.
SMS / text messaging terms
By opting in, you agree to receive recurring account, service, and support text messages from Telimatic — for example onboarding and account notifications, service and outage alerts, billing and renewal reminders, and support follow-ups.
How to opt in. You can opt in online during signup in the Telimatic console by providing a mobile number and actively checking the consent box, or by texting START to our program number. Providing a number and consent is optional and is not a condition of using the Services or of any purchase.
Message frequency varies. Message and data rates may apply.
Help and cancellation. For help, reply HELP, INFO, or SUPPORT, or email support@telimatic.com. To stop messages, reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT at any time; you will receive a single confirmation and then no further messages from the program. Reply START to resubscribe.
Carriers are not liable for delayed or undelivered messages. Your mobile opt-in information is handled as described in our Privacy Policy and is not shared with third parties or affiliates for their own marketing or promotional purposes.
Fees and billing
Paid Services are billed according to the plan or order you select. Unless stated otherwise, fees are non-refundable, and you are responsible for applicable taxes. We may change pricing on a going-forward basis with notice as described in your order or plan.
Intellectual property
Telimatic and its licensors own the Services, including all related software, trademarks, and content we provide. These Terms do not grant you any right to our trademarks or branding. You retain ownership of the content and data you submit, and you grant us the limited rights needed to operate and provide the Services to you.
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, Telimatic will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amounts you paid to us for the Services in the twelve months before the event giving rise to the claim.
Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Services or other users. Provisions that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except where applicable law requires otherwise. The courts located in Delaware will have jurisdiction over any dispute that is not subject to arbitration or small-claims resolution.
Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, provide additional notice. Your continued use of the Services after an update means you accept the revised Terms.
